Lange Uhren watch shape appeal dismissed
The Court of First Instance of the European Communities gave its ruling today in Case T‑152/07 Lange Uhren GmbH v OHIM. In this decision, available so far only in French and German, the Court dismissed Lange Uhren's appeal against the refusal of OHIM's examiner and the Board of Appeal to allow the registration of the sign depicted here as a three-dimensional Community trade mark for "montres [watches] et instruments de mesure du temps; cadrans de montres". The mark was refused on the absolute ground of lack of distinctive character. The appeal, which challenged that decision and additionally pleaded that distinctiveness had been acquired through use, was dismissed.
