The sweet smell of Alhambra -- perfumes and fertilisers

Today's Telegraph reports that leading fashion and luxury goods company Giorgio Armani is facing legal action from authorities in the Spanish city of Granada after launching a fragrance named after its famous Alhambra monument. The fragrance, named Oranger Alhambra, is described as "an olfactory hymn" to the gardens of the Andalusian fort. However, it is reported that the new brand has been launched without authorisation to use the trade marked name. The trustees of the monument have approached the fashion house for an explanation and could seek legal action if no "mutually beneficial" arrangement is forthcoming. The director of the board of trustees, Maria del Mar Villafranca, is quoted as saying:

"Armani have not sought permission. The use of a trade mark associated with a
public monument and world heritage site should not be used for private gain".

Armani has apparently been given until 1 September to respond, failing which the matter will go to litigation.

The article states that, since 2001, "commercial use of the word Alhambra has been restricted to protect the reputation of the UNESCO World Heritage site". Class 46 notes that Alhambra is however an international trade mark for, among other things, pesticides, fungicides and fertilisers registered in the name of Bayer AG. Iberpaint holds a Community trade mark for Alhambra for paints and wall-linings and another Spanish company, Instalaza, has registered the word as a Community trade mark for explosives and firearms.
