Posted by: Blog Administrator @ 09.48* GIFAM v Google France and others, a decision of the French Cour de Cassation which discusses, among other things, whether an agreement between a trade organisation -- which is suing Google for trade mark infringement in relation to its keyword sales -- and its members is contrary to the provisions of the Treaty on the Functioning of the European Union;
* Praline Shapes II, in which the German Bundesgerichtshof considers, with regard to a trade mark consisting of the shape of a chocolate praline, whether the exhibition of a chocolate in a confectionery fair is a "use in the course of trade" for trade mark purposes;
* Smullen v Gourmet Burger Kitchen Ltd, in which the Irish Patents Office assesses the likelihood of confusion that might result between the earlier mark GOURMET KITCHEN BURGER and the later GOURMET BURGER KOMPANY.
