OHIM, MARQUES affirm support for "no boundaries" policy on CTM genuine use
The OHIM website reports that the Association of European trade mark owners, MARQUES, has expressed concern over recent decisions by some national IP offices which imply that, for a Community trade mark to be genuinely used in the European Union, it must be used in more than one country.

In this report, OHIM continues to consider that boundaries of Member States should not play a part in assessing “genuine use” within the EU Single Market, as outlined in the Office's contribution to the European Commission study on the functioning of the trade mark system in Europe. In a video interview Tove Graulund (right), MARQUES's representative on OHIM's Administrative Board, spoke about the group's view on "genuine use" and commented on the need for user input on cooperation activities betweeen OHIM and national offices. She also gave MARQUES's view on the organisation of the EC study.
