No hole in the Hedge: earlier mark sees off rival
The Court of First Instance has ruled this morning in Case T‑67/08, Hedgefund Intelligence Ltd v Office for Harmonisation in the Internal Market, Hedge Invest SpA, that the the applicant's sign (above) is likely to be confused with that of the opponent (below).
The opponent's earlier Community trade mark was registered for 'financial affairs' (Class 36), and the opposition was in respect of services in Class 36 (‘information, advisory, consultancy and research services relating to finance and investments; preparation of reports relating to finance and investments’) and 41 (‘arranging and conducting of conferences and seminars relating to finance; publication of financial information’).
