The annual Question the IP Judges event took place at UCL in London on 18 October. Hosted jointly by UCL-IBIL and MARQUES, it again provided perspectives on a range of IP issues from four judges – each of whom brought different experiences and views.

Judges Meeting in Sweden

The latest Judges Meeting in Sweden was held on 10 October in Stockholm.

The two main items on the agenda were the new order of trade mark law proceedings and Swedish trade mark proceedings in relation to EU law. The following judges took part: The Patent and Marketing Court - Anders Dereborg, Senior Judge, Head of Division at the Patent and Marketing Court

Angela Boman, of AWA, was one of the moderators. She said the popularity of the event showed that "the judges want to be transparent and have a dialogue with the IP community and get input where possible". The new proceedings were introduced about two years ago with the launch of specialist courts for trade mark, design, copyright, marketing and competition law. The judges provided a number of tips on how the procedures are working in practice, the role of the Patent and Registration Office, evidence in trade mark cases etc. The second part of the programme focused on the changes to be implemented following the EU Trade Mark Directive. Legislation has been proposed and is expected to be in force early next year. Angela said the biggest changes are likely to be the abolition of the graphical representation requirement and the ability to request proof of use in opposition and infringement cases: "This means there will be no need for a counterclaim and you will be able to request the plaintiff to prove use of the mark in the proceedings.
