Upcycling: the repurposing of branded products
The final article in our series on the evolving relationship between consumers and brands looks at upcycling. Todd Bontemps of the MARQUES IP Outer Borders Team introduces it
Upcycling is the creation of new and better products from used and or discarded products. In recent years websites and blogs have cropped up selling upcycled products to consumers, while even more offer a "how to" guide for consumers to upcycle at home. E-commerce platforms have given creators the opportunity to commercialise these upcycled products to a much wider audience. The popularity of these sites and their products is ever-growing and it has not gone unnoticed by brand owners. While consumers are embracing upcycling and its environmentally conscientious message, brand owners whose trade marks are used on upcycled products are faced with a dilemma. Do they act to prevent use of their brands in a manner over which they have no control or do they embrace this growing movement and harness the social and environmental messages that it sends? Is upcycling a new lease of life for a branded product or is it the unauthorised tarnishment of its owner's reputation? In Upcycling: The Repurposing of Branded Products we consider the implications for brand owners. Read all of the articles on the evolving relationship between consumers and brands on the IPOB Team page on the MARQUES website. Todd Bontemps is a Partner of Cooley LLP and a member of the IP Outer Borders Team
