Retail therapy? Apple's shop lay-out is not precluded from registration, rules CJEU

The Court of Justice of the European Union (CJEU) gave its keenly-awaited ruling today in Case C-421/13Apple Inc. v Deutsches Patent- und Markenamt, affirming that the same criteria for registrability apply to all types of trade mark.


In 2010 Apple registered the three-dimensional trade mark depicted on the right in the United States. The mark consisted of a representation, by a multicoloured design, of its flagship stores. That trade mark was registered for ‘retail store services featuring computers, computer software, computer peripherals, mobile phones, consumer electronics and related accessories and demonstrations of products relating thereto’. 3 is famous and 5 is a zebra: On stripes as trademarks

Some (delayed) thoughts on the recent 5-stripes judgment of the General Court in Case T-85/13K-Swiss, Inc. v. OHIM / K�nzli SwissSchuh AG, on which see Laetitia Lagarde's timely and informative note (citing the difference with the decision of the Swiss Supreme Court) and also that of Alberto Bellan on IPKat.

Readers of this blog will recall that the General Court allowed the cancellation of K-Swiss 5-stripe trademark below, on the grounds that it does not live up to the required minimum degree of distinctive character since that design (5-stripes) does not depart significantly from the standard designs that are shown on the sides of these kind of products and will be perceived simply as decoration. Relax! WIPO gives Hague Agreement an administrative spring-clean

In a recently-published document "Hague Agreement Concerning the International Registration of Industrial Designs: Amendments to the Administrative Instructions", Hague Announcement No. 3/2014, the World Intellectual Property Organization (WIPO) lists numerous amendments to the Administrative Instructions to the Hague Agreement Concerning the International Registration of Industrial Designs.
