MARQUES is pleased to present a
"first impressions" summary and discussion of PepsiCo v Grupo Promer
Mon Graphic, the much awaited first substantive decision of the
Court of Justice of the European Union concerning a Registered Community
Design (RCD) which is due to be handed down on 20 October 2011. This
promises to shed some light on several aspects of design protection,
including "the informed user", "the assessment of overall impression" and
the "degree of freedom of the designer" |

MARQUES Designs Team, will summarize the decision,
followed by a panel discussion of RCD users and designers (panel to be
announced). |

| Why: |
For a long time,
design rights have been the ugly duckling of the IP world. Recently, the
"tablet wars" in Europe have shown just how powerful RCDs can be -
particularly with respect to pan-EU injunctions. And the fact that
design rights can also cover logos and stylised words means that
understanding these rights is now essential for IP practitioners. |
