Meet the Judges in Portugal
|
MARQUES held its first Meet the Judges event in Portugal on 6 December, with about 45 people attending the meeting at the Museu do Oriente in Lisbon

“It is a big space, and we were worried about how we would fill it!” said José Amorim of Gastão Cunha Ferreira, one of the organisers. “But the meeting was even more successful than we expected, and both the audience and judges really enjoyed it.” Two of Portugal’s three specialised IP judges took part: Judge Mrs Eleonora Maria Pereira de Almeida Viegas and Judge Mr Luis Manuel Chaves da Fonseca Ferrão. The sessions were moderated by Alexandra Paixão of Gastão da Cunha Ferreira Lda, Gonçalo Paiva e Sousa of Gómez-Acebo & Pombo Abogados SLP and Paulo Monteverde of Baptista, Monteverde & Associados. The meeting started at 9am and finished at 3pm and there were three sessions followed by a general discussion. The judges took part in each session, and the other participants included Eng Rita Faria of Empresa Condado Portucalense, Sociedade de Vinhos, Lda and Dr André Robalo of the Portuguese Patent and Trademark Office.
The topics covered by the sessions were: (1) Principle of confusion – need for adjustment to the sophistication of the market; (2) Unfair competition – autonomy facing private rights and judicial practice?; and (3) Indemnification arising from trade mark infringement and the indemnification by the applicant for preliminary injunctions. “The topics were introduced by the moderators, and the judges were happy to take part in the general discussion on each topic,” said José. “This is the first time we have managed to hold such an event in Portugal, and we are very grateful to the judges and the moderators, who all worked hard to ensure the success of the event. We hope to hold it again soon!”
