David Stone and Sebastian Fischoeder of the MARQUES Designs Team attended the recent Designs Liaison Meeting hosted by OHIM in Alicante

 

 

Expected changes to OHIM practice as a result of the planned reforms to the Directive and Regulation were discussed at the 14th Liaison Meeting on Trade Marks, which was attended by Robert Guthrie and Alessandra Romeo

The meeting was held in Alicante on 6th and 7th October. OHIM presented the major changes that the reforms to the Directive and Regulation will introduce and how they will affect OHIM practice.

OHIM?s Knowledge Circles have started to draft the definitions of practice that should apply after the changes are implemented, including regarding Goods & Services (Article 28(8) of the Regulation); Absolute Grounds (new Article 7(1)(j)); and Relative Grounds (Article 8(4)(a)).

The final legal texts are expected to be published by the end of November, after which OHIM will finalise the relevant revisions of Guidelines and open a period of consultation for users associations and IP offices.

The Liaison Meeting also included a review of the feedback received on the WP1-2016 of OHIM Guidelines and the definitions of practice prepared by the different Knowledge Circles.

Note that OHIM also released an improved version of the online design application form on 28th September (see also the report from the Designs Liaison Meeting in this issue of HouseMARQUES).

Robert and Alessandra, and other members of the EU Trade Mark Law and Practice Team, will provide further updates on the implementations of the EU reforms in future issues of HouseMARQUES.
