Tips for Madrid users
|
WIPO has published some practical tips on the Madrid System, including on the restriction on extension of old applications to new contracting states.
|
MARQUES members will know that the holder of an international registration under the Madrid system may extend its geographical protection at any time by filing a request for a subsequent designation.
However, a Contracting Party may, when acceding to the Protocol, declare that an international registration effected before the date of entry into force cannot be extended to it.
Contracting parties that have made that declaration, with the dates of entry into force, are: Estonia (18th November 1998), India (2nd July 2013), Namibia (30th June 2004), Philippines (25th July 2012) and Turkey (1st January 1999).
Owners of international marks need to be aware of these limitations, particularly regarding India and the Philippines, which are two of the most recent states to join the Madrid system.
The tips are published in the latest edition of Madrid Highlights. They also include advice on what is recommended and not recommended to avoid mistakes on the list of goods and services.
WIPO has published an updated list of contracting parties and signatories to all of the treaties it administers online (dated 2nd July).

Cancellation due to non-use in Russia
