Guido Baumgartner of Coty Prestige Lancaster Group was elected
MARQUES
Chair for a period of two years at the Winter Meeting in Venice this
month.
Guido was previously one of two Vice Chairs. He takes over from Jane
Collins of Syngenta, who stepped down after her two-year term.
He said his objectives, which are shared by the
MARQUES
Council, are
threefold. First, he will focus on the financial well being of the
Association: “Given the economic situation, we need to keep this aspect
constantly in mind and work on it.” He added that the Treasurer and
Vice-Chair will take the main responsibility for this. [View full

OHIM - CTM Fee Cut Confirmed |
|

Representatives of EU
member states have agreed to cut Community trade mark fees by 40% as part of
a compromise solution to deal with OHIM’s budget surplus.
The so-called
Comitology Committee yesterday confirmed a combined application and
registration fee of €1050 (€900 if filed electronically), which is a 40%
reduction on existing fees. The changes are due to come into force by
July 1 this year but the precise date and transitional arrangements are
still to be confirmed.
As part of the
agreement, 50% of renewal fees will be diverted to national trade mark
offices. Before this income stream is established, a cooperation fund of €50
million will be established to distribute part of OHIM’s surplus to the
national offices. OHIM”s administrative board, which
MARQUES
recently joined, will administer the fund.

Locarno Pilot Working Group |
|

MARQUES has
been invited to participate as observer at the next meeting of the Locarno
Pilot Working Group, which will take place in Prague. The Pilot Group is
intended to look at the development of the Locarno Classification on
Designs. David Stone, chair of the
MARQUES
Designs Team, will represent
MARQUES
at the meeting. |

Sustainable
Brands
A Luxury or a Necessity?
The 23rd
MARQUES
Annual Conference
will be held in Brighton, U K from Tuesday 15th to Friday 18th September
2009 and will look at the importance of aligning brands with long term
sustainable business policies. Topics will include working with
charities and environmental brands, environmental issues, transport, people
& HR policies as well as food and health claims.

Following the success of the first two reports on the first 150 and 300
decisions on the Invalidity of Registered Community Designs, the
MARQUES
Designs Team have now extended the report to include the first 400
decisions of the Invalidity Division on the invalidity of Registered
Community Designs.

New Team Created |

At the
recent Winter Meeting it was agreed that a new
MARQUES
team would be created. The China Team will be in charge of providing
information and business tools to protect and enforce IPR in China. The team
will have its first meeting during the Annual Conference in Brighton.
Mr Loke-Khoon Tan of Baker & McKenzie, Hong Kong will head up the new team. |

Between
29 January and 6 February 2009 a series of three "Roving Seminars for the
Promotion of Knowledge on Geographical Indications" co-organised by WIPO and
the Department of Industrial Policy and Promotion of the Ministry of
Industry and Commerce of India was held in that country. The seminars took
place in Chennai, Bangalore and Kolkata and Miguel Angel Medina, Chair GI
Team of
MARQUES and
associate partner at ELZABURU, took part in them by means of a speech with
the title: "Protection of Geographical Indications in a Selection of Indian
Export Markets", which dealt with the protection of GIs under the EU, US and
Chinese systems. More detailed information will follow in the

New Cases Available |

MARQUES

from pan-European and national tribunals, has been added to the Case
Database. This months cases include Honda Motor Europe Ltd's
appeal to the Court of First Instance in respect of the word mark 'MAGIC
SEAT' as well as Giorgio Beverly Hills, Yell Ltd and Giropay GmbH.
