  OHIM - MARQUES Gains Observer Status  
  The Administrative Board of OHIM has decided to grant MARQUES, the association of European trade mark owners, observer status as an international non-governmental body concerned with the use of the Community trade mark and Community design systems. Observer status is granted for a period of two years. The first Administrative Board Meeting which MARQUES will be attending in its new capacity takes place in Alicante on 4 and 5 May 2009.

On receipt of the news MARQUES Chairman, Jane Collins said “It is a very special moment for us. We sent a letter in February last year proposing that users were accepted as observers, and I am delighted that member states see the value of users’ contributions. We already have an excellent cooperation with the OHIM and look forward to working with the member states and our colleagues in the other organisations. The decision shows that the Administrative Board wants to take the wishes and needs of brand owners very seriously.”

 
 
 
  OHIM - Changes to Community Search System  
  The CTM E-Filing system was officially launched on Monday 2 February. The new CTM E-Filing service has been largely developed using users' feedback.  The new CTM E-Filing tool is simpler and introduces some new features such as the immediate receipt of filing confirmation and the option to save draft applications in MyPage.

  Trade Mark Users' Forum  
  Christina Duch, MARQUES External Relations Officer has prepared a report on the workings of the Trade Mark Users' Forum and it activities.   The Trade Mark Users' Forum organised by MARQUES was established in 2005 and brings together representatives from most National Patent and Trademark Offices with representatives from MARQUES, AIM and BusinessEurope.   The report in Adobe PDF format is available for download at [http://www.marques.org/Elink?ID=0051]

  Czech Arbitration Court Pilots UDRP e-Filing  
 

The Czech Arbitration Court has launched a three month pilot programme to test its new UDRP platform. All MARQUES members are invited to join the pilot which features several innovative features.

To access the new UDRP Platform all you need to do is to log onto: www.adr.eu. Then click on the button that runs horizontally across the top of the page called “On Line Arbitration Platform”, register your contact details and follow the simple instructions.

If you have any technical difficulties, you can contact the CAC’s UDRP Support Team by e-mailing udrp@adr.eu.

  New Cases Available  

MARQUES is pleased to inform its members that this months selection of cases, drawn from pan-European and national tribunals, has been added to the Case Database.   This months cases include Silberquelle Gmbh v Masellie Stirckmode Gmbh in which a controversial ruling is made as to whether the use of a trade mark on promotional drinks given out for free is considered genuine use, other cases include The Body Shop v Men's Body Shop BV, Lancaster v Federal Institute of Intellectual Property and The North Face Apparel Corp v Sture Bäckman.
