  Anti-Counterfeiting & Parallel Trade Team  
  Custom Activities Relating to Counterfeit and Piracy  
 

On behalf of MARQUES the Chair of the Anti Counterfeiting Team, Joachim Hofmann, Syngenta Switzerland attended in Brussels on October 7, 2008 a meeting on European Commision DG TAXUB. It is a meeting on custom activities relating to Counterfeit and piracy. The minutes of this meeting can be found at the MARQUES website section Anti Counterfeiting Team.

Furthermore, the EC DG TAXUD has developed a "Manual" (Intellectual Property Rights - Manual for lodging of applications for Customs Action) in cooperation with the members which are attached in addition to the "meeting minutes" and a copy of the current Regulation ("Council Regulation (EC) No 1383/2003 of 22 July 2003 concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be taken against goods found to have infringed such rights").

  Applicant Guidebook  
  ICANN has published an Applicant Guidebook addressed to all those interested in applying for a new gTLD franchise. This announcement is a new step within the programme of ICANN to create up to 500 new gLTDs in 12 months from summer 2009.   Keyword Advertising

  Designs Team  
  Locarno Classification system for Industrial Designs  
  MARQUES has released a position paper on the proposed changes to the Locarno Classification system for Industrial Designs. This paper is co-signed by Jane Collins, Chair of MARQUES, and David Stone, Chair of the MARQUES Designs Team. The paper has been sent to WIPO and OHIM and can be downloaded by clicking here.  
     
  Registered Community Design Datase and Article 71  
  MARQUES has sent a letter to Mr Wubbo De Boer (OHIM) on the Registered Community Designs database and Article 71 of the relevant Implementing Regulation. This letter is co-signed by Jane Collins, Chair of MARQUES, and David Stone, Chair of the MARQUES Designs Team.  The letter can be downloaded by clicking here.

  WIPO Case Studies  
  WIPO is seeking Case Studies to enrich its database of teaching materials and has asked whether MARQUES members are able to assist with this.

A case study should be aimed at business managers and others who wish to obtain skills in IP assets management. It should also allow instructors and students to participate in group discussions to explore the ideas and problems presented.

A case study should reveal how business managers have taken decisions concerning the effective creation, protection, leveraging and commercialization of IP assets, which in turn have contributed to building an sustaining competitive strength and generating value.

In developing and writing a text fro a Case Study, the following requirements need to be borne in mind:
  • The case should be based on real events
  • The case should contain sufficient specific information to help to evaluate the outcome of the business decision and consider alternative courses of action
  • The case should concern a business management decision on intellectual property of a firm and/or its competitor(s)
  • The case should contain elements useful to discussions on how business strategy should be formulated and improved by considering aspects of intellectual property, and how intellectual property should be managed to effectively create and extract value from the firm’s business
  • The case should include published and secondary sources, for example: newspaper and magazine articles, books, survey summaries, web sites, etc.

  The Publications & Website Team is currently monitoring the progress of a European trade mark law and information source created by a group of MARQUES members and supporters. This is the Class 46 weblog, which currently contains nearly 700 separate, searchable items of news including notes on recent decisions, laws, official notices and commercial news. Class 46 is interactive, so you can post comments (all comments are moderated). The Class 46 weblog is free to all, and carries no advertisements or pop-ups.   Trademark Law & Practice Team  
  Communication 4/03 of the President of OHIM  
  MARQUES has released a position paper on the Communication 4/03 of the President of OHIM concerning the use of class headings in lists of goods and services for CTM applications and registrations from Knud Wallberg, Chair of the MARQUES Trademark Law and Practice Team, and Jochen Höhfeld, who is in charge of the MARQUES EU Sub Team within the Trademark Law and Practice Team. The paper was sent to OHIM last week and can be downloaded by clicking here.
