European Commission Study:

Responding to the request of MARQUES (Amicus Curiae Committee), the government of Poland filed its observations to The Court of Justice of the European Communities on the question referred for a preliminary ruling to The CJEC, case No. C-495/09 Nokia Corporation v HMRC. The government of Poland gave an affirmative answer to the referred question, as asked by MARQUES in the Comments of the Amicus Curie Committee.

The government of Poland expressed the position that an interpretation of the term "counterfeit goods" that would impose on customs authorities a requirement to determine whether an intellectual property right has been infringed prior to undertaking any actions.

The Anti-Counterfeiting & Parallel Trade Team have published a report on the Amendments to the Spanish Criminal Code which will come into force on 23rd December 2010.

he British Brands Group and Anti-Counterfeiting Group have published a Manifesto for Brands.  The Manifesto contains a six point plan for the greater creation of wealth, jobs and competitiveness.  The report is available from the Brands & Marketing Team pages.

The Geographical Indications Team has compiled list of online Geographical Indication Databases.  The list of databases are available here.

The Cyberpsace Team have have published a report on the Google keyword advertising case, in a long-awaited ruling, the Court of Justice of the European Union confirmed on 23 March, 2010 that Google's lucrative AdWords business does not breach trade mark law (Case C-236/08).  Click here to download the report.
