Now in its sixth year, Class 46  is dedicated to European trade mark law and practice.  This weblog is written by a team of enthusiasts who want to spread the word and share their thoughts with others.

October ETMR now out
The October 2011 issue of the European Trade Mark Reports (ETMR), published monthly by Sweet & Maxwell, contains English-language reports, together with informative headnotes, of recent decisions from national and EU courts and intellectual property offices.  This issue contains reports concerning just three cases:

* Case C‑324/09 L’Oréal SA, Lancôme parfums et beauté & Cie, Laboratoire Garnier & Cie, L’Oréal (UK) Limited v eBay International AG, eBay Europe SARL and eBay (UK) Limited, a Court of Justice ruling on the responsibilities of internet service hosts and the manner in which orders might be made against them which many readers of this weblog will already know very well;

* Joined Cases C-4/10 and C-27/10 Bureau national interprofessionel du Cognac v Gust. Ranin Oy, where the Court of Justice examines the uncomfortable relationship between national trade marks and EU-wide geographical indication.

* Case C-132/07 Beecham Group plc and others v Andacon NV, a really obscure Advocate General's Opinion on the use of information obtained from one set of proceedings in order to prove a case in another set of proceedings. This case, which was removed from the Court of Justice's register, arose from an action in respect of the customs detention of pharma products. It is referred to from time to time in ECJ proceedings.
