Finnish trademark office changing its classification practice regarding “retail services” in class 35

In its website, National Board of Patents and Registration of Finland (NBPR) has announced that as of June 1, 2010 trademark registration applicants must specify in the classification of service class 35 to what goods are “retail services” related. The specification requirement concerns both the national Finnish applications as well as international registrations designated to Finland which are filed on June 1, 2010 or after that. Additionally, any limitations to the list of goods of earlier registrations and pending applications filed after said time limit need to be specified if they contain term “retail services”. Besides the term “retail services” the specification is required for similar services like resale, wholesaling and on-line sale services.

Regardless of the new practice it is still possible to apply registration for the class heading of class 35 when it is considered to cover retail services related to any kind of goods.
