Latest ETMR now published
The June 2009 issue of the monthly Sweet & Maxwell series European Trade Mark Reports carries reports on a number of cases, on this occasion mainly from the European Court of Justice and the Court of First Instance. Cases in this issue include
* Case C-93/08 Schenker SIA v Valsts ienemumu dienests, a ruling on the legality of the provisions of Latvian law that relate to the infliction of an administrative fine upon a customs agent acting on behalf of the consignee of counterfeit goods; * Gateway Inc v OHIM, in which the ECJ dismisses the opponent's appeal against refusal to uphold an opposition to the registration of "ACTIVY Media Gateway" which was based on a number of earlier marks containing the word "Gateway"; * Laytoncrest v OHIM, a ruling that explains that you can't assume that a party has withdrawn from proceedings solely on the basis of it having failed to participate actively in them.
