Exceptional extension of the opposition deadline against recently published community trade mark applications
The OHIM has published a notice to inform applicants, as well as potentional prior rights owners, that the opposition deadline regarding rencently published applications will be augmented.
The notice explains that:
The introduction of the new workflow management system for Community trade marks has resulted in the lack of availabilty of up to date information in certain tools, such as CTM ONLINE and CTM DOWNLOAD, that the Office makes available to users. Despite the regular publication of Bulletins 007/2009, 008/2009 and 009/2009, the lack of up to date information on CTM ONLINE combined with the unavailability of CTM DOWNLOAD has constituted an exceptional occurrence that has dislocated proper communication from parties to the Office, specifically as regards filing of oppositions in respect of applications for Community trade marks published in part A1 of Bulletins:
The Office states that after consulting some OHIM Users Group Associations, it decided that a Determination of the President under Rule 72 (4) will be issued, so that the periods for expiry of the filing of notices of oppositions in accordance with Article 42 CTMR are extended one extra month with regard to Community trade marks published in both above cited Bulletins.
