Poland: "prior tempore potior iure" in "primus inter pares"?
The Polish newspaper Kurier Lubelski reports an ongoing dispute regarding primus inter pares, a Latin slogan which is used by two students' organizations - Niezalezne Zrzeszenie Studentów (Independent Students' Union) and Zrzeszenie Studentów Polskich (Polish Students Association) - as the name for a well-known contest for talented Polish students. The name was used by ZSP for over 30 years but the situation changed when a director of the contest decided to establish the Primus Inter Pares Association and quickly applied for a trade mark registration. ZSP filed an opposition proceeding before the Polish Patent Office but, for two years, both associations have pursued each other in organizing the "Primus Inter Pares" contest. Such status quo brings confusion to many universities participating in this event. The PPO decision is expected to be delivered on March. The preparation for this year's event has already begun.
